General and specific conditions of sale for the ""FontRémy"" gîtes updated September 2023
[1] Holiday rental subject to confirmation by William (the owner) to the tenant (the client).
[2] To reserve the property, the client must complete and sign the reservation form as well as the general and specific conditions of sale of the ""FontRémy"" gîtes and return them electronically accompanied by the initial non-refundable deposit (30% of the total rent due). After receipt of the reservation form, the general and specific conditions of sale of the ""FontRémy"" gîtes and the deposit, the owner will send you a confirmation. This is the formal acceptance of the reservation (except for certain reservation platforms). The reservation is nominative.
[3] The balance of the rent together with the security deposit (see clause 4) are payable at least eight weeks before the start of the rental period. If payment is not received by the due date, the Owner reserves the right to give written notice of cancellation of the booking. Bookings made within eight weeks of the start of the rental period require full payment at the time of signing the booking.
[4] A security deposit of €300 per stay or part of the rental week for the Wisteria, Honeysuckle and Jasmine houses and €500 for the ROSE house is required in the event of damage to the property and its contents. However, the amount reserved in this clause does not limit the client's liability towards the owner. The owner will be required to account to the client for the security deposit and to refund the balance due within two weeks of the rental period. Any breakages during the rental period must be accounted for by the owners and deducted from this security deposit. Please report any breakages immediately to the manager. This makes it easier to check stocks.
[5] Subject to paragraphs 2 and 3 above, in the event of an uninsurable cancellation, a refund of the sums paid will be made if the owner is able to re-let the property. Any costs or losses incurred will be deducted from the refundable amount. The client is strongly advised to take out comprehensive travel insurance (including cancellation cover) and to fully cover the party's personal effects, civil liability, or holiday type insurance contract for these various risks, as these are not covered by the owner's insurance.
[6] The rental period begins at 4 p.m. on the first day and ends at 10 a.m. on the last day. The owner is not obliged to offer the accommodation before the time indicated and the client is not authorized to remain in business after the time indicated. The contract is concluded for a fixed period and the tenant may not under any circumstances claim any right to remain in the premises at the end of the stay.
[7] The maximum number of persons who may reside in the property must not exceed the advertised capacity, unless the owner has written permission. If the number of tenants exceeds the capacity, the owner may refuse the additional persons. Any modification or termination of the contract will therefore be considered at the tenant's initiative.
[8] The client agrees to be a considerate tenant, to take good care of the property and to leave it clean and tidy at the end of the rental period. The "first" cleaning must be done by you before departure (dishes must be washed and put away, bins emptied, floors swept, refrigerators in good condition, linen removed and placed at the foot of the bed (if linen option validated), the oven without burnt food. The owner reserves the right to make a deduction from the security deposit (€80 for Rose and €60/house for the other houses) to cover additional cleaning costs if the client does not follow the instructions requested.The Client also undertakes not to act in a way that disturbs the residents of other FontRémy properties and the residents of neighboring properties; the owner reserves the right to make a deduction from the security deposit to cover the noise nuisance caused to the neighborhood.
[9] The Client must report without delay to the Owner's agent any defect in the Property, breakdown of equipment, machinery or appliances in the Property, the garden or the swimming pool, and arrangements for repair and/or replacement will be made as soon as possible.
[10] The Owner shall not be liable to the Customer for: [a] any defect or temporary interruption in the supply of utilities to the Property, as well as any equipment, malfunction or breakdown in the Property, garden or swimming pool. [b] any loss, damage or injury resulting from adverse weather conditions, riots, war, strikes or any other matter beyond the control of the Owner. [c] any loss, damage or inconvenience caused to or suffered by the Customer if the Goods are destroyed or substantially damaged before the start of the Rental Period and, in such event, the Owner shall refund to the Customer within seven days of being notified all sums already paid in respect of the Rental Period.
[11] In no event shall the Owner's liability to the Customer exceed the amount paid to the Owners for the rental period.
[12] What's included: Electricity and water are included, but we reserve the right to charge for any excessive usage (inflatable pool prohibited, electric vehicle connection prohibited, etc.).
[13] Swimming pool - the pool is heated from mid-May to mid-September (weather permitting). If you wish it to be heated outside of these dates a fee will be charged (however we reserve the right to refuse depending on the period requested). Smoking, drinking or eating is not permitted in or around the pool area. It is not allowed to use the property's own towels. Please bring your own pool/beach towels . It is not allowed to put a personal pool (inflatable type or similar) for toddlers
[14] Smoking is prohibited in the houses. Outside, there are bins provided for this purpose.
[15] Sorry, animals not accepted.
[16] It is not permitted to bring outdoor furniture into the house. Conversely, it is not permitted to take indoor furniture out of the house. It is not permitted to move tables from terraces to green spaces. The owner reserves the right to make a deduction from the security deposit to cover the cost of repairs or replacement in the event of damage.
[17] Condition report and inventory: the tenant has 12 hours to check that the premises are in accordance with the description given and to report any anomalies noted to the owner. After this period, the rented property will be considered free of damage upon the tenant's entry. In the absence of a contradictory inventory at the end of the rental, the absence of any objection by the owner within 72 hours following the end of the rental will be deemed to be the return of the premises in good condition and with a complete inventory.
[18] Disputes; in the event of a dispute, the competent court will be that of the headquarters of the company SARL FH2G.
[19] Pandemic / COVID; the measures in force decided by decrees of the government(s) are and will be applied. It is the customer's responsibility to find out about the provisions with which he must comply for himself and on behalf of all persons present on the property, for whom he has been duly authorized to validate this agreement. It is strongly recommended to take out cancellation insurance. All health recommendations, which are possible for us, are implemented.
[20] All electrical connections, access and parking are prohibited on the entire property for tents, camper vans and similar vehicles.
